When You Fire An Employee | What to Expect

Fire An Employee & Legal Aspects

Here’s what happens after you fire an employee. She’s angry and she knows the law protects her. So, she meets with her employment lawyer and tells her story. And, when you didn’t handle the termination properly, the lawyer will get a big smile on his face because he knows a big payday is coming his way… all at your expense.

How big of a payday? Let me give you a few real life examples of wrongful termination cases...

A 63-year-old director of a food services company sued for age discrimination in El Paso, TX. The company claimed they terminated the director for poor performance. The jury didn’t believe the company and awarded the former director $10,400,000. (Case Source: Jury Verdict Research)

A 45-year old maintenance man sued his supervisors and the hospital he worked for. He claimed the supervisors terminated him in retaliation for taking leave under the Federal Medical Leave Act. The hospital gave no reason for the firing. He received a total jury award of $11,240,000. (Case Source: Jury Verdict Research)

A waitress in a motel coffee shop sued for wrongful termination and sexual harassment. She received $122,563 for lost wages, emotional distress and punitive damages. And the jury awarded her extra $375,000 to pay her attorney’s fees for a grand total of $497,563! (Case Source: Employment Termination Law by Maureen E. McClain.)

According to Jury Verdict Research, the average jury award for wrongful termination was $536,927. This is the average over the last 6 years, so probably you'll have to pay a larger award this year.

I want to refer you to the last wrongful termination example about the coffee shop waitress. Can you believe the waitress’s attorney made $375,000 for just this small case? This clearly shows you why so many frivolous wrongful termination cases go to court in this country. The lawyers encourage them because it’s a way they can get rich off the backs of honest business people while the “wronged” worker only gets a fraction of the total award.

It isn’t any secret that I don’t like employment lawyers. They’re not real businesspeople. They don’t run departments, lead companies and work in a team environment like you and me. They line their pockets and drive new BMW’s and Lexus’s by profiting off the suffering of others.

If you have ever been robbed, they’re the bandits with the guns stuck in your back. These bandits make you feel helpless, inadequate and cowardly. They’re the primary reason we can’t get rid of our poor performers and replace them with good people.

Here’s the problem. They know all the laws and the tricks inside and out. And this is how they take advantage of you.

But, it doesn’t have to be this way. You can outsmart them, but you need to know how. This best source of information on this is the Termination Guidebook by Dan Betts. In his Guidebook, Dan shows you exactly how to terminate properly. To learn more on how to protect yourself and your business, click fire an employee.
